In exercise of the powers conferred by section 197 of the Jammu and Kashmir Water Resources (Regulation and Management) Act, 2010, the state Government has made the Jammu and Kashmir Water Resources (Regulation and Management), Rules, 2011. This has 7 chapters. Chapter I contains definitions; prohibition of certain acts affecting the water works utilities; and prohibition on construction over water works utilities. Chapter II deals with drinking water supply and water for commercial use. Chapter III has specific rules for irrigation and flood control, which deals with prohibition on use of water from irrigation work without permission; water usage charges for use of water for irrigation purposes; regulation of water supply from irrigation work; application for permission to use water from an irrigation work; prohibition on sowing, cultivating or growing certain crops in the irrigation area etc. Chapter IV deals with the installation of a unit. Any person intending to install a unit requiring usage of water for the purpose of generation of electricity, supply of drinking water or water for irrigation, running of water mill or exploitation of groundwater shall, after preparation of a scheme, submit the same to the Jammu and Kashmir Water Resources Regulatory Authority for approval. Chapter V deals with ground water. Grant of permit is necessary to extract and use ground water in the notified area. Chapter VI gives the composition of State Water Resources Regulatory Authority. Chapter VII deals with general complaints.
